Terms and Regulations for services by the service ceneo.eu

These Regulations specify, among others the rules of services by the service ceneo.eu These general conditions contain the most important information about the entity providing services and about the rights and obligations of the parties. The Terms and Regulations are continuously available by the Service Provider on the Website at the following URL: https://ceneo.eu. , in a way that allows its Users to download them, record or print and restore at any time. The Service Provider may publish advertising content on the service Website regarding the Services offered as well as goods and Services of third parties in forms available on the Internet. The use of such offers or services is not a part of the Website and the rules of such are defined by relevant third parties.

  2. Service Provider – Ceneo.pl spółka z ograniczoną odpowiedzialnością with its registered seat in Poznań, address: ul. Grunwaldzka 182, 60-166 Poznań, entered into the Register of Entrepreneurs of the National Court Register held by the District Court Poznań – Nowe Miasto i Wilda in Poznań, VIII Commercial Division of the National Court Register under KRS number 0000634928, NIP (tax identification) 525-26-74-781, REGON (statistical) number 365338986, with a share capital of PLN 5,000,000;

    User – an adult person with unlimited rights, using the Website ceneo.eu in accordance with its intended use and with respect for the Terms and Regulations;

    Website – a service in the internet network maintained and administrated by the Service Provider. Available at the following url: ceneo.eu, used to provide Services to Users;

    Services – services provided by the Service Provider to Users via internet under and within the boundaries of the Act on Provision of Electronic Services that transposes Directive 2000/31/EC of the European Parliament and of the Council of 8 June 2000 on certain legal aspects of information society services, in particular electronic commerce, in the Internal Market (“Directive on electronic commerce”);

  6. To use the Website properly, you need at least:
    • Electronic device with access to the Internet;
    • Internet browser that supports JavaScript with enabled cookies;

  8. The use of the Website is free of charge. By accessing the Website the User has the opportunity to get acquainted with information about offers of products from third parties which sell products. The Service Provider is not a seller or a party to any transactions made by Users in online stores whose offers are published on the Website.

     
  9. Rights and obligations of the parties
    1. All rights to the Website, including proprietary copyrights, intellectual property rights to its name, internet domain, Website, as well as to forms, logos, and other content posted by the Service Provider belong to the Service Provider, and the use of them may occur only in a specified manner and in accordance with the Terms and Regulations.
    2. It is forbidden to copy, reproduce, modify or distribute any part of the Website, Services or their elements without the prior written consent of the Service Provider, except as expressly permitted by the applicable law and the Terms and Regulations. The Service Provider may take steps, including through court proceedings, to protect the interests of both its own and Users.
    3. It is forbidden to use the Website in an automated manner or which may disrupt the operation of the Website, violating the provisions of generally applicable law, good manners, intellectual property of third parties, personal rights of third parties or legitimate interests of the Service Provider. In particular, it is forbidden to publish unlawful content.

     
  10. Liability
    1. The sole source of obligations of the Service Provider is these Terms and Regulations and the mandatory provisions of law.
    2. The Service Provider does not mediate in concluding agreements between Users and third parties referred to in point 4 herein above for products offered by these entities. The sole responsibility for the content available on the Website from third parties, in particular: discounts, promotions, discount actions, product descriptions, product images shall be borne by third parties which are the organizers of these promotional campaigns.
    3. The Service Provider shall not be liable for any damages caused by the User due to the User's use of unsecured and antivirus-free computer connected to the Internet. In particular the Service Provider shall not be liable for hacking the system and electronic mail used by the User, password or login taking over by third parties, virus infections User's computer systems.

     
  11. Complaints
    1. The User may submit complaints regarding the Services provided on the Website.
    2. Complaints may be submitted in writing, in the form of registered mail, to the following address: Ceneo.pl sp. z o.o., ul. Legnicka 48 G, 54 – 202 Wrocław, Poland or by sending a message to an e-mail address: admin@ceneo.eu
    3. A complaint should include the person lodging the complaint (name, surname, e-mail address) and a description of the event that caused the complaint. If the data or information provided in the complaint needs to be supplemented, before considering the complaint, the Service Provider shall ask the User to supplement it in the indicated scope.
    4. Complaints shall be considered within 14 days from the date of receipt by the Service Provider of a correctly filed complaint (containing the required elements and not requiring supplementation).
    5. The User shall receive information on the method of handling the complaint via electronic correspondence to the e-mail address provided in the complaint.
    6. In the event of the complaint procedure shall not bring the result expected by the consumer, the consumer may use the Internet ODR platform available at: http://ec.europa.eu/consumers/odr/.

     
  12. Final provisions
    1. In the event of a dispute, Polish law shall be applicable for terminating the dispute.
    2. The Service Provider reserves the right to change these Terms and Regulations to the extent permitted by applicable law, including in the event of significant reasons related to the technical or substantive aspect of the Website, in particular in the event of relevant changes in applicable law.
    3. Amendments to the Terms and Regulations come into force from the date of their publication on the Website at ceneo.eu, subject to the provisions of the next points of the Terms and Regulations. The Service Provider shall inform the Service Users about the change in the Terms and Regulations by posting an appropriate notice on the change of the Terms and Regulations on the Website pages in a way that allows Users to analyse these changes. The Service Provider may also additionally inform Users about the change of the Terms and Regulations by means of internal communication mechanisms on the Website.
    4. In the absence of acceptance of changes in the Terms and Regulations, the User may withdraw from the contract with the Service Provider. In order to withdraw from the contract with the Service Provider, the User should refrain from logging in to the Website and immediately notify the Service Provider of the withdrawal to the following address: admin@ceneo.eu The User should also delete the Account on the Website.
